Car Accident Fatally Injures Modesto Man
I’m Ed Smith, a wrongful death attorney in Modesto. A man from Modesto was behind the wheel of his vintage vehicle northeast of Modesto on the afternoon of Saturday, October 7, 2017. The man was involved in a car accident with one other vehicle. Unfortunately, the collision caused the man to suffer fatal injuries.
Our sincerest thoughts and condolences are with the loved ones of Michael Harry who passed away in this devastating car accident.
Information About the Crash
A Modesto man was driving his light blue 1967 Plymouth Barracuda northbound along Terminal Avenue in the vicinity of Claus Road at approximately 4:10 pm. For unknown reasons, the right tires of the Plymouth veered onto the shoulder of Terminal Avenue. The man allegedly attempted to overcorrect his vehicle and lost control. The Plymouth spun counterclockwise and into the southbound lane of travel and in the direct path of an oncoming black 2012 Honda Accord. The driver of the Honda was unable to avoid the Plymouth, resulting in a serious collision.
Officials from the California Highway Patrol (CHP) reported that the impact of the collision split the Plymouth in half. The front-end of the Plymouth was propelled along the west shoulder of the roadway. The other half of the vehicle came to a rest along the southbound lane. The motorist of the Plymouth was allegedly ejected upon impact.
Was Anybody Injured?
The driver and the passenger of the Honda, 24-year-old Joaquin Parado of Modesto and 26-year-old Emely Corona of Newman, both suffered major injuries resulting from the car accident. They were transported to the Doctors Medical Center and Memorial Medical Center for treatment. The motorist of the Plymouth, unfortunately, succumbed to his injuries at the scene. The Stanislaus County Coroner’s Office revealed the identity of the man as 45-year-old Michael Harry of Modesto.
What Caused the Accident?
It is still too soon to determine an exact cause of the accident. A Traffic Collision Report requires thorough investigation by officials. These reports may take up to two weeks to be processed. It is important to contact an experienced Modesto accident lawyer to help determine fault for a crash, especially when someone has passed away and cannot give their version of the events. Additionally, police reports can be inconclusive or in error pertaining to fault.
Wrongful Death Claim
A wrongful death is a legal term used to define a death that was caused by the negligence or fault of another party or corporation. The common causes of motor vehicle accidents leading to a fatality include the following:
- Automobile Defects
- Driver Fatigue
- Driving Under the Influence
- Inclement Conditions
- Reckless Driving
- Roadway Defects
- Texting and Driving
There is a basis for filing a wrongful death claim against the liable party. In most situations, a wrongful death lawsuit must be filed within two years from the date of a loved one’s death. The California Code of Civil Procedure sections 377.60-377.62 only permits certain persons related to the deceased party to file a wrongful death claim.
