What Happened?
This first fatal West Sacramento accident occurred during the late evening of Tuesday of May 31, 2017. A truck being driven by a driver under the suspension of driving under the influence was traveling west on West Capital Avenue when he hit another vehicle. The continued momentum of the truck carried it to the side of the road where it fatally struck a woman waiting at a nearby bus stop.
The Results of the Crash
The woman, the victim of this fatal pedestrian accident, died at the scene. The driver of the car who is not under suspicion of driving under the influence is receiving treatment for minor injuries at the hospital. The offending truck driver, a 23-year-old West Sacramento man by the name of Gerardo Lopez was arrested at the scene of the accident by authorities for suspicion of felony DUI driving and driving with a suspended license.
Who is Liable in a DUI Case?
If you or a family member suffers injuries or wrongful death in an accident where an impaired driver is involved, you have the option to pursue compensation for the damages. As is expected any person who operates a vehicle while impaired by alcohol, drugs, or heavy prescription medication is considered negligent and is responsible for the damages incurred. Even this can be little comfort when dealing with injury or the loss of a loved one. Recovery of damages will not heal the wound but will negate medical bills and other accident-related costs.
Other parties can also be liable. Many states have enacted laws that put some liability on establishments and people providing alcohol in an improper manner. A business has the expectation to exercise a duty of care and refrain from serving those with obvious signs of intoxication. Even the provider of the vehicle causing the accident is liable if they have reason to believe that the offending driver was under the influence at the time of receipt.
