North Freeway Boulevard Crash Caused by Out-of-Control Driver
A rollover accident resulting in an injury happened in Natomas when a vehicle went out of control on January 12. The crash happened along North Freeway Boulevard around 1:13 p.m, according to the incident report by the California Highway Patrol (CHP). The driver of the vehicle apparently lost control of their Nissan sedan, struck a fire hydrant and a tree and then overturned.
Vehicle Totaled in Rollover Accident
The vehicle was so damaged that a tow truck with a flatbed trailer had to be called to remove it because the Nissan was missing both axles. One injury was reported in the accident. An investigation is ongoing by authorities to determine the cause of the collision.
Single-Vehicle Accidents
Single-vehicle accidents are more common than you might think. Although some are due to driver error, this type of accident happens for a variety of reasons. Because of that, it is critical that your legal team examines the vehicle as well as the surrounding area for evidence of an outside influence. On occasion, the driver is unable to describe what happened due to his or her injuries. Some of the reasons a single-vehicle accident happens are:
- Vehicle defects: Frequently, defects in the brakes, tires, engine, or accelerator can cause a single-vehicle accident. It is important that the vehicle be preserved so that our investigators can examine it to determine why the crash occurred. If a defect caused the accident, our legal team of injury attorneys is able to mount a lawsuit against the manufacturer. In California, product liability lawsuits are governed by the law of strict liability, which maintains that the manufacturer is liable if the auto defect caused injuries, and it is unnecessary to prove negligence.
- Government negligence: Potholes, debris on the road, and other obstacles to safe driving can be blamed on the city, county, or state agency in charge of roadway maintenance. If they don’t do their job, it is possible to file a claim against them in civil court. The time limit for filing this claim is different from other lawsuits, and your attorney will be able to ensure that all documents are filed in a timely manner.
- Another vehicle: Due to the high incidence of hit-and-run accidents, it is extremely possible that a single-vehicle accident is due to a fleeing driver’s negligence. Our investigative team searches for evidence that points to this. Our attorneys are able to use this information to build a strong case for our client.
Rollover Accident Dangers
When a vehicle encounters roadway obstacles or loss of driver control due to defects, chances are the vehicle will overturn. This is because it interferes with the vehicle’s balance. When the vehicle flips over, the occupants can be ejected onto the roadway or exposed to roof crush. The latter is usually due to manufacturer negligence, which results in a lack of supportive infrastructure to maintain the weight of the vehicle.
There are federal standards that must be met in terms of roof strength that is needed to protect the occupants in a rollover accident. The infrastructure must be able to support three times the weight of the vehicle.
